Dispute with insurance value! Can anyone help please?
Hello all
My insurance company has written off my 2.8 Sport :-( They have offered me less than half what I believe is a reasonable retail replacement cost and are currently refusing to budge. I have a Parkers valuation, but they won't take that into account, being a 'consumer' guide. In order to strengthen my case, I could really do with CAP and/or Glass' (preferably both!) 'Retail' values weighted for milage and options. I believe you can only get these as a motor trade professional. Does anyone have access to these, or know someone that may be able to help? I would be very happy to pay for the trouble! Thanks :-) |
There must be some sort of arbitration/ombudsman service?
|
Hi. Yes, there is and I'm prepared to go down that route if absolutely necessary. Right now though, I'm attempting to persuade them to up their offer, and I need more 'ammunition'. I have a couple of written valuations from local traders which I haven't yet sent to them, and could really do with CAP and Glass' values to go with them, to really push my point home. If they still refuse to budge after that, then I would have no choice but to go to the Ombudsman.

The FOS is the place to go - link below https://www.which.co.uk/consumer-rig...rance-provider But follow their advice about doing things in the right order first +++ |
That's a helpful link, thanks! :-)

What valuation have they used? Do they not need to use the CAP/Glasses valuation too with adjustments for mileage etc?
For mine I sent in links to similar vehicles for sale showing their valuation wasn't even in the ball-park. I also had (obtained, thanks to the helpful seller) the receipt as I'd only bought the car 6 months prior but I don't think this will be helpful in your case as you've owned the car a while now. I also contact a chap called Tim Kelly here https://www.motorclaimguru.co.uk/ who said he would be able to help if needed. Cost would have been about £200 but potentially can be reclaimed from third party! I hope you can get it sorted. Edit: Check legal case Coles v Hetherton too https://www.fenchurchlaw.co.uk/coles...overy-actions/ |
Thanks a lot for that! I've contacted Tim.
Insurer has said in writing that their valuation is Glass' 'Retail'. It's so low however, I just struggle to believe it. I did manage to find a CAP 'trade' value (although can't get CAP 'Retail' irritatingly!), which is only just slightly below their value. I think they might be using Glass' 'Trade' value, which obviously is considerably lower than Retail. I asked them for a scan/screenshot/link to the valuation, and surprise surprise, as yet I haven't received it... |
As it was not your fault it should be the other drivers insurance who payout.
Is the car 'Beyond reasonable cost of repair' or beyond repair? If its repairable then insist its repaired. The other drivers insurance should pay up if faced with a huge bill maybe they'll be more susceptible to a reasonable offer. Just a thought. GL CtL |
Let me know the reg, and mileage and I'll get you a glasses valuation.
But, I'll warn you I've seen a number of older cars come back at scrap value recently, so it might not strengthen you case..... Work checking though. |
