Default Another 8 going off road

Mu mates A8 was hit by uninsured driver who had taken car from his relative without permission. Rear wheel is kicked out of place so it is uneconomical to repair.

That's a real shame hope the police throw the book at the little scrote!! Even if the family member doesn't want to press charges, if they want their insurance to pay out they'll have to report the car as taken without consent, I suspect.

What about all these insurers promises "if you're hit by an uninsured driver...."

He could/should press for full a repair. Unless he actually wants a change of car of course.

2003 D2 FL S8. Irish Green Pearl/Beige. Solar sunroof, auto-dim mirrors, electric rear seat functions, ski hatch retrofit; extended leather. Aftermarket DVB-T, reversing camera and full XCarlink (Bluetooth etc.).
2016 Volvo V40 T5 Cross Country (4WD) with ALL the toys including adaptive cruise etc. etc. Osmium Grey with Blonde/Charcoal leather interior. Polestar performance "optimisation". (A much rarer model than a D2 S8 by the way!) Oh, and a brand new engine at just under 30,000 miles on the factory one!
Finally: gone, but not forgotten.....
1998 D2 PF S8. AgateGrey/Platinum. Every option (I think) except electric rear seats, tiptronic steering wheel, ski hatch, towbar & dimming door mirrors.
e.g. Cruise control, NavPlus/TV, Bose, GSM, Xenons, Solar roof, Parking sensors, Alcantara/leather everywhere of course. (internal dimming mirror added later)
1998 (very early) Ford Focus 1.8 Zetec; ABS/TCS, Heated screen/mirrors, Aircon, Auto-dim mirror, Leather, Trip computer, Cruise control, OEM Ford SatNav with CD changer.
And before that a lot of Rover 800s, a few oddities, a lovely Triumph Dolomite 1850HL with Overdrive and way back in my schooldays an Austin Seven aka Mini 850!

Sorry to hear this, love the colour of the car, what a crying shame.

I was hit by an uninsured driver a number of years ago, damage was limited to a door skin which I ended up paying for myself. Went to court and just before the case was called she pleaded guilty and she received a ridiculously small fine, if I wanted to claim I would have to sue her. What was the point as she would never have paid as she never had a job...So much for the laws of this country.

Hope you manage to get the financial side sorted out without too much hassle.

Police is informed. Driver will face the court ad most likely get driving ban, fine and possibly community work. My mate only has TP,F&Theft insurance so not covered if hit by uninsured driver. No point contacting insurance. The other driver is mechanic and promised to repair the car but as it stands now my friend is pressing him to pay full value of the car and give car to him so that he can repair or do whatever he wants with it.

Surely you can either claim against the other party's insurer, or if they consider it to have been stolen, can make a claim via the MIB scheme here:

The fact the '8 isn't insured fully comp will actually work to his advantage in this case as MIB won't, I believe, pay out if your own insurance would cover the cost.

He has nothing to lose and he should report the damage to his insurer as it's a material fact. There may well be a record of it via police or insurer database so best to be up front, otherwise he may have future insurance cancelled.

However, it also looks like your friend was parked next to a road junction - within 10m is a breach of the Highway Code, the other driver might even be able to get off on the technicality that strictly speaking the 8 was parked illegally

Parts 243-244 Highway Code:

243

DO NOT stop or park

near a school entrance
anywhere you would prevent access for Emergency Services
at or near a bus or tram stop or taxi rank
on the approach to a level crossing/tramway crossing
opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space
near the brow of a hill or hump bridge
opposite a traffic island or (if this would cause an obstruction) another parked vehicle

You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking on the pavement can obstruct and seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams or pushchairs.
