I've seen cp kick in during updates on b8 platform cars, but usually it clears itself during the update process. I think it detects a change during the firmware update but it runs so quickly once the other modules catch up it doesn't usually 'stick' so no need to have it removed. Same applies on cars with or without B&O which seem similarly afflicted as Bose on d3.
Maybe the d3, being cd based updates, takes that bit longer so cp can't clear itself as the modules restart?
My local Indy now has necessary access to clear cp - having to drive a customer car down to the main dealer for removal every time they changed a component was becoming a bind!
