Drink Driving...

This caught my eye a few weeks ago, and wasnt really relevant, but now I'm in a hotel and downed a good bottle of red, it seems more pertinent  Ignoring the fact that the car is trashed, and basically scrap, its a really interesting comment he makes that says drink driving made his insurance invalid. I didnt think that was the case. Sure, you'll get prosecuted, and your insurance will be sky high from then on, but didnt think they'd have the option to bail of of paying ? They must have a legal obligation to pay 3rd party damages surely, but then, what if you have a lease purchase / contract hire agreement / company car where someone else is expecting any damage to paid by insurance. Are we saying you have a drink and all bets are off ? I dont condone drink driving, never have and never will, but whether you have a heart attack, fit, sneezing attack or get drunk and under the influence decide you're a great speed demon, I always thought fully comp insurance was there to protect the asset, whoever owned it... Anyone any experience of this ?

this is what my policy says
11 Drink and drugs clause If an accident happens whilst you or any person entitled to drive under Section 5 of your current Certificate of Motor Insurance is convicted of an offence involving drink or drugs, or was driving under the influence of drink or drugs, no cover under the policy will be provided and instead, our liability will be restricted to meeting our obligations as required by the Road Traffic Act. In those circumstances, we reserve the right to recover from you or the driver, all sums paid (including all legal costs), whether in settlement or under a Judgment, of any claim arising from the accident. ohh and I am no expert but think he might be underestimating the cost of fixing this, dont you?

yeah but it suggests they claim what they paid out to third party from the policy holder, so even if you dont go to jail or die, doubt very much if you could afford to eat, let alone buy and run a car

Hang on. So, if you go drinking, then drive, and crash, taking out say half a dozen 30K motors in the process, then you're looking at a mortgages worth of debt coming your way pdq. Why the heck done they put *that* on the xmas drink / drive campaigns.. !!

This looks like a perfect opportunity for some low life to do an identity change on a 'ringer'.
Also on the subject of insurance, something more outrageous in my opinion - My wife had a motorcycle, a little 125 from new (Honda Shadow) with some nice custom parts (declared). She became too ill to ride it (rheumatoid arthritis & a failed knee replacement) or even get on the back of my Harley. Despite all of this, she kept the 'bike in my garage, fully insured and after 4 years & only 88miles on the odo, she did the logical thing and sold it for v good money a couple of months ago. The insurance was paid in full up front, and when the 'bike was sold she informed them, thinking she was going to get a substantial refund on the policy, as it was only 3 months in........ Ha..... Ha..... Ha...... They only wanted to CHARGE her £25 for the privilege of cancelling the policy, and NOT refund a single penny! After an argument, they waived the fee.... but no refund despite the 'risk' being removed & no accident/ claims in the intervening period CAVEAT EMPTOR!
