Default Insurance Scam on me ! Advice please ...

im not going to mention exact details
basically what happened is this

a car with identical number plates to mine was involved in an accident last november.
this was 200 miles away from me.
it seems like the 2 parties only exchanged number plates (weird)
anyway..in nov. i got a phone call from my ins. saying why had i not reported this?
i said WHAT? i know nothing about it thats a scam i said.
MID came up with my car they said.
so i got the blame.
5 months later my ins is due Guess what, i was about to lose my NCB
i went ballistic at them as they had done nothing.
So using a private detective 72 hours later the culprit has been found
Owned up to it too
cost me lots.
Got my NCB back but a ACCIDENT NON FAULT NO PAYMENT marker on my insurance.

What shall i do next ?

If I knew who it was (especially if they've owned up to it) I'd sue the culprit.

Or at least invoice them and give them 30 days or so to settle for a 'reduced amount' before taking legal action. Make them aware that legal costs will be added too if it goes to court.

As it's insurance fraud I would have though the insurance co and the police would want to know, maybe I'm being naïve though!

there must be an ombudsman who can force them to take that marker off

someone tried to scam my gf a few years ago by claiming she knocked in to them, falsley, she rang the insurance company to report the faker , the faker didnt make a claim after i had a word on the phone with them, but guess what, marker

ive made a formal complaint to my insurers
ombudsman will be next

question is, does the marker make any difference to the renewal quote ?

Not sure about insurance companies nowadays, but I had a NON FAULT accident 20 years ago (sitting stationary at a roundabout and was driven into). It still affected my renewal quotes for the following few years.

If the initial complaint fails, you could also try the data protection route. They are keeping personal data about you, so principle 4 of the act apples here - information stored must be accurate and up to date

Fines from the ICO can be pretty scary!
